ONE MONTH FREE TRIAL” PROMOTION
HOW TO CLAIM
1. To
be eligible to claim, individuals must purchase, a Fisher & Paykel
DishDrawer dishwasher, internal part code 523010, from a participating
store within Australia and New Zealand between 01/09/09 and close of
business on 28/02/11. Participating Fisher & Paykel dishwashers
will have a card showing a unique code contained in the DishDrawer of
the dishwashers.
2. To
claim, claimants must then visit www.morningfresh.com.au, follow the
prompts to the competition claim page, input the requested details,
including their unique code and submit the fully completed claim form
by 11:59pm AEDST on 28/02/11. Once the online claim is submitted
successfully, the Morning Fresh DishDrawer Tabs will be sent via mail.
TERMS AND CONDITIONS
1. Instructions
on how to claim and the offer form part of these Terms and Conditions.
Participation in this promotion is deemed acceptance of these Terms and
Conditions. Offer not valid in conjunction with any other offer.
2. Claims are only open to Australian and New Zealand residents.
3. Employees (and their immediate families) of the Promoter, participating
retailers and agencies associated with this promotion are ineligible to
claim. Immediate family means any of the following: spouse, ex-spouse,
de-facto spouse, child or step-child (whether natural or by adoption),
parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece,
nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. The
Promoter reserves the right, at any time, to verify the validity of
claims and claimants (including a claimant’s identity, age and place of
residence) and to disqualify any claimant who submits a claim that is
not in accordance with these Terms and Conditions or who tampers with
the claim process. Errors and omissions will be accepted at the
Promoter's discretion. Failure by the Promoter to enforce any of its
rights at any stage does not constitute a waiver of those rights.
5. Incomplete, indecipherable, or illegible claims will be deemed invalid.
6. Only one claim permitted per household.
7. If
there is a dispute as to the identity of a claimant, the Promoter
reserves the right, in its sole discretion, to determine the identity
of the claimant.
8. Promotion commences on 1st September 2009. Claims close 11.59pm AEDST on 28th February 2011.
9. The Promoter’s decision is final and no correspondence will be entered into.
10. Every
valid claim received will be awarded a month’s supply of Morning Fresh
DishDrawer Tabs, which consists of two (2) boxes of Morning Fresh
DishDrawer Tabs (containing 20 tablets each), valued at $7.49 each (as at 12/05/09).
11. Offer is subject to the standard terms and conditions of individual offer and service providers.
12. In
the event of war, terrorism, state of emergency or disaster, the
Promoter reserves the right to cancel, terminate, modify or suspend the
promotion,
13. If for any reason a claimant does not redeem the offer by the time stipulated by the Promoter, then the offer will be forfeited.
14. If the offer
is unavailable, the Promoter, in its discretion, reserves the right to
substitute the offer with an offer to the equal value and/or
specification.
15. Offers, or any unused portion of an offer, are not transferable or exchangeable and cannot be taken as cash.
16. If
this promotion is interfered with in any way or is not capable of being
conducted as reasonably anticipated due to any reason beyond the
reasonable control of the Promoter, the Promoter reserves the right, in
its sole discretion, to the fullest extent permitted by law (a) to
disqualify any claimant; or (b) to modify, suspend, terminate or cancel
the promotion, as appropriate.
17. Claimants
consent to the Promoter using the claimant’s name, likeness, image
and/or voice in the event they are successful claimant (including
photograph, film and/or recording of the same) in any media for an
unlimited period without remuneration for the purpose of promoting this
competition (including any outcome), and promoting any products
manufactured, distributed and/or supplied by the Promoter.
18. Any
cost associated with accessing the promotional website is the
claimant’s responsibility and is dependent on the Internet service
provider used.
19. The
use of any automated software or any other mechanical or electronic
means that allows a claimant to automatically claim repeatedly is
prohibited and will render all claims submitted by that entrant invalid.
20. Except
for any liability that cannot be excluded by law, the Promoter
(including its officers, employees and agents) excludes all liability
(including negligence), for any personal injury; or any loss or damage
(including loss of opportunity); whether direct, indirect, special or
consequential, arising in any way out of the Promotion, including, but
not limited to, where arising out of the following: (a) any technical
difficulties or equipment malfunction (whether or not under the
Promoter’s control); (b) any theft, unauthorised access or third party
interference; (c) any claim or offer that is late, lost, altered,
damaged or misdirected (whether or not after their receipt by the
Promoter) due to any reason beyond the reasonable control of the
Promoter; (d) any variation in offer value to that stated in these
Terms and Conditions; or (e) use of the offer.
21. The
Promoter collects personal information in order to conduct the
Promotion and may, for this purpose, disclose such information to third
parties, including but not limited to agents, contractors, service
providers, offer suppliers and as required, to Australian regulatory
authorities. Claim is conditional on providing this information. The
Promoter may, for an indefinite period, unless otherwise advised, use
the information for promotional, marketing, publicity, research and
profiling purposes, including sending electronic messages or
telephoning the claimant. Claimants should direct any request to
access, update or correct information to the Promoter. All claims
become the property of the Promoter.
22. The
laws of Australia apply to this promotion to the exclusion of any other
law. Claimants submit to the exclusive jurisdiction of the courts of
Australia.
